COURT REFUSES TO IMMEDIATELY SIDE WITH HULK HOGAN ON BLOCKING SEX TAPE ONLINE

United States District Judge James Whittemore shot down Hulk Hogan's request for a preliminary injunction against Gawker.com and the other associated defendants that would have forced the website to remove their review and the one minute clips of Hogan's sex tape with Heather Clem, PWInsider.com has confirmed.

In a ruling issued this morning, Judge Whittemore ruled that Hogan had "failed to show that immediate and irreparable injury, loss or damage" would happen if the material was not pulled before the defendants had a proper chance to respond to the court and argue against the injunction.

Thus, a hearing on the injunction is now set for 11/8 at 3 PM in Tampa where all sides will get to argue over the motion and the Judge can make his final ruling on the matter.

Hogan has until 10/31 to file any additional material he has on the injunction issue. The Defendants have until 11/2 to file any affidavits with the court.

The hearing will not be open to the public, per the orders of the Judge.
