TAMMY SYTCH UPDATE

Tammy Sytch has yet to see a Judge regarding her probation violation arrest and there is no scheduled hearing in regard to Sytch being taken into custody this past Friday, PWInsider.com has been told.

In checking with the Palmerton, PA Police Department today, we were told that they did not arrest Sytch on Friday, although they were called to her home that day.  Sytch was later taken into custody by the Carbon County Probation Department, we are told and is awaiting a court hearing.  According to The Carbon County Courthouse, Sytch's name does not currently appear on any upcoming dockets, so there's no currently known timetable as to when she will go before the court.    We were told it is possible she may be seen before court records are updated.

The nature of Sytch's probation violation remains to be seen.  She remains incarcarated at Carbon County Correctional Facility.  Sytch being taken into custody follows a previous hospital stay from Monday 9/12 to 9/20.  Just three days later, she was brought back to the hospital and then taken into custody.

Sytch was sentenced to five years' probation on 8/18 in Carbon County Court by Judge Joseph J. Matika after pleading guilty to three DUI-related arrests from 2015.  At that time, Sytch was sentenced to serve a total of 97 days to five years in prison but in lieu of prison time, was instead given credit for 95 days in rehab and two days she spent in prison and was placed on her aforementioned probation.

At the time, Judge Matika warned Sytch that should she get into trouble during the time period of her probation, which was to feature bi-weekly drug and alcohol testing, she would be sentenced to jail as there would be zero tolerance for any drug and alcohol use.  During the sentencing, Sytch was also ordered to pay fines of $2,100 as well as court costs of $1,000 and $50 per month fee to cover the cost of her court-mandated supervision.  Sytch also had her driver's license suspended for 30 months and was ordered to complete 125 hours of community service.

The DUI charges stemmed from three different arrests over a three week period in 2015.

On 5/30/15, Sytch was stopped by Mahoning Township, PA police after being seen driving erratically into a Wal-Mart parking lot. A test showed a 0.25 percent Blood-Alcohol level.

On 6/1/15, Sytch was pulled over after her car crossed the solid center yellow line several times and then entered oncoming traffic on Interchange Road in Lehighton, PA.  Sytch was unable to provide proof of insurance or a drivers license and was identified via authorities checking records.  When he stopped her at 10510 Interchange Road, Lazarchick said she was unable to provide a driver’s license and proof of insurance. He identified her through a records check.  Trooper Jonathan Lazarchick of the Pennsylvania State Police reported that her eyes were bloodshot and glassy and that she smelled like alcohol.  There was an open bottle of Coors Light in the passenger side of the vehicle and another 11 unopened.  The open cap was on the floor of her passenger's side.  Sytch claimed she had been drinking the night before, was driving to pick up milk and eggs and when asked to get out of the vehicle, staggered, had problems with her balance and needed to lean on her car to maintain her balance.    Her blood-alcohol content was 0.3 percent.

On 6/20/15, Sytch crashed her car into a ditch in Towamensing Township at 10:40 p.m. and claimed to authorities responding that her GPS had told her to made a "sudden turn", leading to her turning too wide and ending up in the ditch.  Sytch told authorities that she was unable to back the car back out.   Cpl. Shawn Noonan of the Pennsylvania State Police observed the odor of alcohol and bloodshot eyes.  He requested Sytch take a field sobriety test but she claimed to be "in too much pain due to her recently blacking out and falling down the steps."  She was taken under arrest for DUI and was given a breathalyzer test back at police barracks.   The results of that test were 0.078 percent.  Sytch would later claim on social media, in response to PWInsider.com's reporting of the case, that she was not arrested for DUI when she crashed her car because she had a "seizure."

Sytch plead guilty to DUI in all three cases as well as one count of driving without a license.  The court dismissed the other lesser charges in each case as part of her guilty plea.   Sytch stated in an interview with Bill Apter that she filed the guilty plea because she was "blackout drunk" during what she termed the worse relapse of her life during that period and legitimately could not remember anything from the arrests.  Since she could not testify in court about what happened and the police had video footage of her in that state, Sytch stated a decision was made to plead guilty as part of an agreement between the two sides.

Six weeks later, she is back in custody.
